RCD-CE Marking 2013/53/UE

UDICER built the whole CE certification process online: draws, outlines, reports and everything else needed for CE branding are developed on electronic support.

The UDICER electronic documents ease the manufacturer to fulfill the technical file of the product, thanks to their compilation control system.

In short the technical file of the product and the different stages of approval can be followed by remote, connecting to the devoted UDICER web page. The access is exclusive and protected by a unique password provided to the manufacturer.

On U-TRACKING EC SYSTEM page the manufacturer can also be aware about possible requests from our technical Office to carry on the procedure.

CE marking modules

The evaluation of compliance is accomplished by forms that provide technical and legislative tools to establish the appropriate process to allow the manufacturer  to prove the compliance of the product towards 2013/53/UE directive’s instructions. It depends on the intervention by the manufacturer or the Notified Body, and it concerns the design, the production phase, or both.

  • Boat: a recreational unit with hull length larger than 10 meters and lower than 24, indepently from the driving force.
  • Vessel: a recreational unit with hull length between 2,5 and 10 meters, indepently from the driving force and excluding jet skis
  • Jet ski: a recreational unit with hull length lower than 4 meters, that use sas driving force a water pump and intended to be activated by oneor more person seasted, standing or on kneees instead of inside of it.

2013/53UE Directive includes in the term “recreational unit”  “boats” and “jet ski”, also partially completed, so defined:

1) «recreational unit», a recreational boat or a jet ski;

2) «recreational boat», any recreational unit, excluding jet skis, intended to sport and leisure activities with hull length between 2,5 and 24 meters, indepently from the driving force;

3) «jet ski», a recreational unit intended to sport and leisure activities with hull length lower than 4 meters that use as driving forcea water pump and intended to be activated by one or more person seated, standing or on knees instead of inside of it;

Legislative degree 11th  January  2016, n. 5, defines a different classification, that  recognize in Italian system the 2013/53 directive :

  1. a) recreational unit: any product intended to sport or leisure activities, classified as recreational boat or recreational vessel or jet ski
  2. b) recreational boat: a recreational unit with length larger than 10 meters and until 24 meters indepently from driving force;
  3. c) recreational vessel: a recreational unit with hull length between 2 meters and 50 centrimetes and 10 meters, indepently from driving force and excluding jet skis;
  4. d) jet ski: a recreational unit with hull length lower than 4 meters, that makes use of a water pump as main propulsion source, and intended to be activated by one or more person seated, standing or on knees instead of inside of it;

With the new 2013/53 directive all marine engines (inboard, stern drive and outboard) have to report the CE branding that attests the compliance of the “product” to the relevant requirements of the Directive itself. They have to be “certified”, for gas and/or noise emission, by the following table:

Internal control of production

(Attached III Legislative Degree 5/2016 – Attached II Dec. 768/2008/CE)

It concerns internal design and production control.

This module doesn’t request intervention of a notified body.

It is the assessment of internal compliance and internal production control by manufacturer himself which complies to duties of: editing of technical documents; guarantee of production and control process, branding and written UE compliance declaration as planned by Attached XIV of Legislative Degree 11/1/2016, n. 5 (Attached  IV Directive 2013/53/UE).

Obligations concerned to manufacturer, as identified on the assessment module, can be fulfilled by his authorized representative, on behalf of manufacturer and under his responsability, as long as specified by the mandate.

A1 Internal control of production with official tests of the product

(Attached  IV Legislative Degree 5/2016 – Attached II Dec. 768/2008/CE).

Internal control of production, with product tests under official control, is the assessment process of compliance of recreational units, jet skis and noise emission, with which the manufacturer complies to duties of: editing of technical documents; guarantee of  production and control process, branding and written UE compliance declaration as planned by Attached XIV of Legislative Degree 11/1/2016, n. 5 (Attached  IV Directive 2013/53/UE).

Obligations concerned to manufacturer, as identified on the assessment module, can be fulfilled by his authorized representative, on behalf of manufacturer and under his responsability, as long as specified by the mandate.

B EU-Type Examination

(Attached V Legislative Degree 5/2016 – Attached. II Dec. 768/2008/CE).

EU-Type examination is part of an assessment process of compliance with which UDICER analyzes the technical drawing of a product, as well as verifies and controls the compliance of the product to the 2013/53/UE.

It concerns the design stage of recreational units and jet skis, and include salso the test of gas emission of marine engines. It has to be followed by a module that provides the assessment on the production phase(modules C,D or F).

EU-Type examination certificate is issued for a typical sample of production evaluated by UDICER in respect of essential requirements of 2013/53/UE Directive

Authorized representative of manufacturer can present the EU-Type examination request and complete the duties of manufacturer himself, as identified in the assessment module, as long as specified by the mandate.

C Type compliance based on production’s internal control

(Attached VI Legislative Degree 5/2016 – Attached II Dec. 768/2008/CE).

It concerns the production stage and follows the B module. It provides the type compliance described un the EU-Type examination certificate issued by B module.

Manufacturer guarantees and declares that products involved are compliant to the type described on EU-Type examination certificate,, and comply with provisions of 2013/53/UE Directive; he edits the written UE Declaration of Compliance, as expected by Attached XIV of Legislative Degree 11/1/2016, n. 5 (Attached IV Directive 2013/53/UE).

This module doesn’t expect the intervention of a Notified Body, except for what required for gas emission assessment of marine engines: in case the manufacturer of engines doesn’t work by rule of an appropriate quality system, as described on module H (Attached  XI of  Legislative Degree 5/2016 – Attached  II Dec. 768/2008/CE)  UDICER  can be called to accomplish products  at regular intervals. Manufacturer, in case of unsatisfying quality level, or if seems necessary to verify thr validty of data presented by the manufacturer himself, it shall apply the extra process of which to attached VI of Legislative Degree 5/2016 (Attached VII of 2013/53/UE Directive). To guarantee the compliance of engine’s sample to the requirements of 2013/53/UE Directive, it shall apply the statistical method described in attached XIII of Legislative Degree 5/2016 (Attached VII of 2013/53/UE Directive).

Obligations being up to manufacturer, as identified in the assessment’s module, can be fulfilled by his authorized representative, in behalf of the manufacturer and under his responsibility, as long as specified by the mandate.

C1 Type compliance based on internal control of production linked with product’s tests under official control.

(All. XVII D. L.vo 5/2016 – All. II Dec. 768/2008/CE).

It concerns the assessment of gas emission of marine engines, if tests are fulfilled without adopting the harmonized reference point. T follows the B module.

Manufacturer complies to duties of: guarantee of production process and control; control on product with tests under UDICER’s responsibility; branding and written UE Declaration of compliance, as expected by attached  XIV of  Legislative Degree 11/1/2016, n. 5 (Attached  IV Directive 2013/53/UE).

Obligations being up to manufacturer, as identified in the assessment’s module, can be fulfilled by his authorized representative, in behalf of the manufacturer and under his responsibility, as long as specified by the mandate.

D Compliance based on guarantee of quality during production process

(All. VII D. L.vo 5/2016 – All. II Dec. 768/2008/CE).

It follows the B module.

Manufacturer adopts an admitted quality system for production, the inspection of conclusive product and the test of involved products, of which UDICER evaluates the compliance with 2013/53/UE Directive.

Manufacturer, subject to UDICER’s monitoring, guarantees and declares, under his exclusive responsibility that involved products are in compliance with the type described on EU-Type examination certificate and meet the provisions of 2013/53/UE Directive.

Obligations being up to manufacturer, as identified in the assessment’s module, can be fulfilled by his authorized representative, in behalf of the manufacturer and under his responsibility, as long as specified by the mandate.

F Compliance to type based on product check

(All. IX D. L.vo 5/2016 – All. II Dec. 768/2008/CE)

It follows module B.

UDICER verifies product’s compliance with type described on EU-type examination certificate issued by module B and implements exams and control tests of compliance of products to pertinent regulations and proving each product or analyzing and proving products on statistical base.

UDICER releases a compliance certificate about exams and fulfilled tests and places, or makes place under its responsibility, its own identification number 0966 on each homologate product.

Obligations being up to manufacturer, as identified in the assessment’s module, can be fulfilled by his authorized representative, in behalf of the manufacturer and under his responsibility, as long as specified by the mandate.

An authorized representative can’t fulfill obligations of manufacturer concerning the fabrication and control process and concerning both guarantee compliance of products to the homologate type described on EU-type examination certificate, as the homogeneity of each produced lot, for statistical test of compliance.

G Compliance based on test of  the unit

It si the essessment process of compliance of recreational units, jet skis, gas and noise emission and parts, with which manufacturer verifies and declares, under his exclusive responsibility, that the product involved is in compliance with requirements of 2013/53/EU directive..

Manufacturer complies obligations of : drafting technical documents; guarantee of production process and control; product test with exams by UDICER; branding and EU written declaration of compliance as expected by Attached XIV of Legislative Degree 11/1/2016, n. 5 (Attached IV 2013/53/EU directive).

UDICER issues a compliance certificate about exams and tests fulfilled and places, or makes place under its responsibility, its own identification number 0966 on approved product.

Obligations being up to manufacturer, as identified in the assessment’s module, can be fulfilled by his authorized representative, in behalf of the manufacturer and under his responsibility, as long as specified by the mandate.

H Compliance based on guarantee of complete quality

(All. XI D. L.vo 5/2016 – All. II Dec. 768/2008/CE)

Manufacturer applies a quality system approved for design, production, final inspection and test of involved product, of which UDICER evaluates the compliance with 2013/53/UE Directive.

Manufacturer, subject to UDICER’s monitoring, places on each product in compliance with 2013/53/UE Directive the CE branding of compliance and, under responsibility of UDICER, the number of identification 0966.

Obligations being up to manufacturer, as identified in the assessment’s module, can be fulfilled by his authorized representative, in behalf of the manufacturer and under his responsibility, as long as specified by the mandate.

APC Equivalent compliance based on post construction assessment

(Attached  XII D. Legislative Degree 5/2016 – Attached V Directive 2013/53/UE)

The processi s adopted when neither the manufacturer neither the agent settled in the community assume responsibility for product’s compliance.

It concerns the check of compliance of:

– recreational units;

– jet skis;

– parts;

– marine engines;

– engines or recreational units after a modification or significant conversion;

– a recreational unit whose function, not considered by current directive, has been modified to insert it into its range of application;

– recreational units builded for personal use before the deadline of  a five years period, for which they intend to place on market.

UDICER analyzes the product and makes the appropriate calculations, tests and other checks needed to guarantee the product’s corresponding compliance to appropriate requirements of 2013/53/UE Directive. It releases a certificate and a related report of compliance about accomplished assessment and places its own identification number next to CE branding on approved product.

In case of recreational units UDICER places also the Craft Identification Number (CIN), composed by:

IT; UDI; certificate number; month and year of assessment.

Person who places product on market, or put it on service, drafts the declaration of UE compliance.

EU COMPLIANCE DECLARATION N. XXXXX

EU compliance declaration  includes a declaration of engine’s manufacturer and of person that adapts  an engine in accordance with art. 6, par. 4, letters b) and c), by which:

  1. a) if installed on a recreational unit following the instructions of installation that accompanies the engines, this last one will satisfy:
  2. i) requirements related to emissions expected by present Directive;
  3. ii) Limit values of which to directive 97/68/CE about engines homologated in  accordance to Directive 97/68/CE that are in compliance with emission limits  of III A phase, of III B phase or of IV phase for engines with compression ignition used for applications different from propulsion of ships for inland navigation, of locomotives and of railcar, as expected by Attached I, point 4.1.2, of this directive; or

iii) limit values of which to regulations (CE) n. 595/2009 about  engines homologated in compliance with this regulation.

Engine must not be put on service untill the recreational unit on which iy has to beinstalled is declared  in compliance, if expected, with relevant provision of present Directive.

If engine has been placed on market during the additional period  of which to art. 55, par. 2, the Eu compliance declaration mentions it..

Related to choice of manufacturer or his agent in the European Economic Area, about  compliance assessment modules , below are described preparation procedures, the conduct and the release of Compliance Attestation  to essential requirements of  2013/53/UE Directive, about:

  • design and construction of recreational units and jetskis;
  • recreational units and jetskis subject to post-construction CE certifications (APC)
  • noise emissions of recreational units, with inboard or outboard engine or outboard without integral exhaust and of jetskis;
  • gas emission of marine engines
  • noise emission of inboard and outboard engines with integral exhaust;
  •  following parts, when are put into community market separately and are allocated to be installed;
  1. Fire protection for inboard and outboard engines with outboard control
  1. System that prevents the start in gear  protection devices for outboard engines
  2. Steering wheel, control system and cables
  3. Fuel tanks intended for fixed installation and fuel hoes
  4. Prefab hatches and portholes
  • Busines sand production’s quality system;

Upon successful conclusion of the displayed certification process, the applicant receives the official document named:

Certificate Model

Certifications concerning compliance assessment of products subject to 2013/53/UE Directive are issued on paper support, anti-counterfeiting, watermark type, with big “Shipswheel approval UDICER” logo  printed by semi-transparent blue ink  and two embossed “Shipswheel Approval UDICER” logos stamped on  higher right corner and on   lower left corner.

1)  Acceptance phase or refusal of certification request

Developer of certification  submits to UDICER’s Secretariat the “Visiting order” UN/EC02/53 model for recreational units and jet skis and UN/EC03/53model  for parts and noise and gas enmission of marine engines;“Visiting order” model identifies th product type or requirement  inspection that will be subject to assessment of compliance to 2013/53/UE Directive.

The Secretariat attributes a progressive alphanumeric number  to the document , which shall be notified to Developer and it always will be mentioned  on correspondence  between him and UDICER, and  forwards it to technical Directorate.

Technical Directorate evaluates the compliance to law requirements of assessment/ request:  if not communicates  to developer  legal motivations of  rejection;

If so, provides the clearance  to the Secretariat which prepares the Contract, on a CONTR CE/53 Model, which includes all the administrative, financial and technical terms, regulating the process of evaluation and emission of certificate request; contract  will be signed both by UDICER, both by developer.

Findings phase

After drafting and reception of contract by the developer, technical Management strts the evaluation process requested.

Developer has to send to UDICER’s Management the technical documents for project production and operation understanding, and to evaluate the compliance to 2013/53/UE Directive.

The list of documents requested by UDICER, concerning to relevant modules of assessment, by product’s  type, is indicated  on “opening” technical File (1/A1/53, for  module A1; 1/B/53, for module B, F e G; 1/APC/53, for Post-Construction certification) which is delivered to Developer.

Control of entirety and compliance of files (internal documentary test for certificate release)

Management examines conformity of  technical documents to requirements expected by 2013/53/UE Directive and to the harmonized relevant regulations. If manufacturer does not adopt harmonized regulations, where these  have not imperative nature, the Management evaluates if the adopted solutions meet the expected requirements.

Technical documents check is accompanied by verifications “on the ground” by UDICER inspection staff and or by laboratory, by reference to:

– UDICER technical files, which include instructions, working and calculations sheets, to essential requirements, gathered according to evaluation modules expected by mentioned Directive relevant to product’s  or inspection’s type;

– UDICER technical guidelines for compliance evaluation to essential requirements of 2013/53/UE Directive.

– Baseline harmonized standards ;

Before dossier closing and  concerning assessment process, Supervisor of compliance Evaluation fully analyzes  each procedure and highlights, with annotations  in red, any observations or corrections to be made to individual items of the dossier. He reports, then, on first page of the dossier, the essential references to finish the verification. Only when all items will get comprehensive answer from compilers and will be elegible by advice of Supervisor, he will sign and date the dossier. This amounts to close the assessment process and gives favourable opinion to verification itself.

Once the assessment process is closed, UDICER Management, in the person of his Supervisor, releases the certificate, on UN/EC 01/53 (see above), that will be numbered by anti-forgery and anti-replication criteria.

UDICER/NAUTITEST has policies and  procedures for resolution of complaints, recourses and of controversies coming from customers or other parts about certification management la or any other issue.

All complaints, recourses and controversies concerning UDICER’s activities should be written addressed  to UDICER/NAUTITEST and reported to technical Supervisor and Administration. Only written complaints  are acceptable for  formal remedies.

Technical Manager is responsible for registration to the Complaints Register and on the module concerning the Non-Compliance Report, to start up an inquest and to arrange the dossier. He can work with the AQ. He can work in collaboration with the AQ (Quality Assurance Manager) and with the responsible of local unit among the developer.

Remedial actions start promptly and its effectiveness verified on next Management meeting .Any interested party can also lodge a complaint against UDICER’s decisions about the following cases:

  • Refusal of certification request
  • Withdrawal, set-aside and annulment of certification

Recourses should be written submitted to UDICER with all available and relevant documentation within three (3) months from decision of rejecting, withdrawal and cancellation.

Technical Supervisor, in response to the lodging of the appeal, draws up a report and, together with the Management, shall decide to accept or refuse the appeal according to the state of affairs and to applicant’s documentation.

The decision shall be written communicated to applicant in a reasonable time so that he can collect the recourse in this phase of the process without any financial obligation.

In case of confirmation of the refusal of certifcation, the person involved can speak to the “ Vigilant Admins” as expected by Art.36 of Legislative Degree 11th January 2016, n. 5; these “Administrations” shal carry out a review within ninety days. Upon that deadline without the acceptance of any decision, the complaint means rejected.
